dc.description.abstractEl presente trabajo es un estudio sobre la Responsabilidad Civil del Estado a la luz de la nueva Ley Federal de Responsabilidad Patrimonial del Estado, la cual entró en vigor a partir del 1 de enero de 2005. Antes de esta fecha, no existía un sistema de responsabilidad patrimonial objetiva y directa a cargo del Estado, como la que ahora se plantea en la nueva legislación. Sólo se contemplaba la responsabilidad civil, ya fuera subsidiaría o solidaria, sin que pudiera hacérsele exigible al Estado de manera eficaz y contundente la reparación de los daños causados por sus servidores públicos. El análisis del caso hipotético realizado en el Centro de la Asociación Libre de Adicciones, A.C., nos permitirá entender mejor la responsabilidad extracontractual objetiva y directa del Estado, así como las obligaciones que nacen con los particulares, respecto a su “actividad administrativa irregular”, la que trae como consecuencia, la indemnización de quiénes no tienen la obligación jurídica de soportar dicho daño. Asimismo, como un ejercicio de aplicación de la referida ley, se analizaron los elementos más importantes de esta figura, como los sujetos de responsabilidad, el daño, la ausencia de obligación jurídica de soportar el mismo, la actividad irregular del Estado y la causalidad.
dc.description.abstractThis document represents a study of the civil responsibility of the State in Mexico under the New Federal Patrimonial Responsibility of the State Act recently enacted and in effect since January 1st, 2005. Before this date, there was no system of objective and direct responsibility for State acts under domestic law. The Law only contemplated a subsidiary recourse to the payment of damages from the State, in case a civil action against a government official was successful and the government official did not have enough money to pay the damages. I work here with a hypothetical case that helps fleshing out the potential challenges that litigators and judges will face in an action under the new Act. The irregular activities of the State that cause a tort to a citizen can now result in the payment of damages by the State to the citizen. To be succesful it is necessary to show that the citizen did not have a legal obligation to suffer the damage. I analyze through the hypothetical case this aspect of the Law, along with other aspects that will represent interpretation and applications challenges of the Act, such as who can be regarded as acting on behalf of the State for purposes of the Law, the notion of irregular activity of the State and the problem of causality and liability.
