Las constituciones políticas de 1857 y 1917 y el proyecto de constitución presentado por el primer jefe: análisis comparativo

Abstract

El trabajo presenta un análisis comparativo de tres cuerpos jurídicos: la Constitución Política de la República Mexicana, sobre la indestructible base de su legítima independencia, proclamada el día 16 de septiembre de 1810 y consumada el 27 de septiembre de 1821, expedida el 12 de febrero de 1857; el Proyecto de Constitución propuesto por el ciudadano Primer Jefe presentado al Congreso Constituyente en la sesión de 6 de diciembre de 1916 por Venustiano Carranza, fechado en Querétaro el 1° de diciembre y el texto de la Constitución Política de los Estados Unidos Mexicanos que reforma la del 5 de febrero de 1857 publicada el 5 de febrero de 1917. La cercanía del Primer Centenario de la promulgación de la Constitución de 1917, fundamento de nuestras instituciones jurídicas constituye un momento propicio para la comparación de estos cuerpos jurídicos con el fin de ahondar en el conocimiento de nuestra norma fundamental. Con tal fin, en estas páginas se ofrece un panorama general de las circunstancias en que se expiden las constituciones de 57 y de 17, destacando que son posteriores a un movimiento social considerado revolucionario; con esa propuesta de trasfondo se explica cómo se generaron y qué representa cada una en el momento que fue promulgada. En la segunda parte se explica de manera pormenorizada cómo fueron marcados los textos que se comparan y finalmente se ilustra la labor realizada con algunos ejemplos extraídos de dicho Análisis. Al ejercicio de comparar estos cuerpos jurídicos le he incorporado instrumentos que facilitan su lectura: una Tabla de Concordancias entre ellos y un Anexo que consta de dos partes, la primera, tiene un cuadro de las reformas, a partir de 1873, fecha en que se modifica el diseño institucional del Estado al incorporarse al texto constitucional los principios de las Leyes de Reforma y poco después, el Senado y termina con la última reforma expedida por Carranza; en la segunda parte del mismo Anexo está el texto completo de dichas reformas, señalando la fuente de la que provienen.

The text presents a comparative analysis of three legal parts: the Political Constitution of the Mexican Republic, on the indestructible basis of their legitimate independence, proclaimed on september 16, 1810 and consummated on september 27, 1821, issued on feb. 12 1857; proposed by the First Chief presented to the Constituent Congress in the session of december 6, 1916 by Venustiano Carranza, dated at Queretaro on december 1 and the text of the Constitution of the United Mexican States draft constitution amending on february 5, 1857 published on february 5, 1917. The proximity of the First Centenary of the promulgation of the 1917 Constitution, the foundation of our legal institutions is an enabling comparison of these legal bodies in order to depend the knowledge of our fundamental norm time. To this end, in these text an overview of the circumstances in which the Constitutions of 57 and 17 are issued, noting that they are post-revolutionary social movement considered is offered; background with that proposal explains how generated and what each one at the time it was enacted. In the second part explains how the texts that are compared were marked and finally the work with some examples drawn from this Analysis is illustrated. Exercise to compare these the incorporated of tools that facilitate the reading of the legal bodies: a Table of Concordance between them and an Annex which consists in two parts, the first, has a picture of the reforms, from 1873, dated that modifies the institutional design of the State to be incorporated into the Constitution the principles of the Reform Laws and shortly after, the Senate ends with the last amendment issued by Carranza; in the second part of the Annex it is the full text of these reforms, pointing to the source from which they come.
