Cádiz y el experimento constitucional atlántico

Abstract

Este trabajo analiza la pertenencia y el lugar de la Constitución de Cádiz dentro del conjunto de la experiencia constitucional atlántica. Después de ubicar contextualmente el debate historiográfico entre quienes reducían el resultado de la deliberación gaditana a meras imitaciones de códigos importados del extranjero y aquellos que argumentaban su defensa en términos nacionalistas e históricos, es posible posicionar el experimento de Cádiz más cerca del ciclo constitucional hispanoamericano que del francés o estadounidense. Un proceso que evidentemente parte de bases teóricas e instituciones desarrolladas por dos importantes experimentos constitucionales precedentes, pero que presenta elementos originales que lo alejan de ser meramente derivativo. En particular se analizan la ambigüedad sobre la naturaleza de los derechos, el historicismo, la intolerancia religiosa y la definición de ciudadanía como elementos propios del texto de 1812.

This article analyses the place of Cadiz’s Constitution within the Atlantic constitutional experiment. After contextualizing the historiographic debate between those that reduced the deliberation that took place in Cadiz to a mere adoption of foreign codes and laws on the one hand, and those defending it on nationalist and historical grounds on the other, the author suggests that the Cadiz experiment is closer to the Spanish American constitutional cycle. The Spanish Constitution evidently departs from the theoretical and institutional framework developed by the two important constitutional experiments that preceded it (the United States and France), but also presents original elements that sets it apart from a merely derivative exercise. This paper stresses the ambiguity of the nature of rights, historicism, religious intolerance and the definition of citizenship as elements proper to the text of 1812.
