El papel de las entidades federativas para negociar e implementar tratados de libre comercio de los capítulos de contratación pública en la política pública a nivel estatal en México

Abstract

El trabajo de investigación establece la conexión entre: (i) la suscripción de Tratados Internacionales Comerciales de México que incorporan capítulos de contratación pública, y (ii) la creación, implementación y mejora de la Política Pública en materia de contratación pública estatal de 1994 a la fecha. Para tal efecto, traza como objetivo principal determinar si la apertura comercial en Tratados Internacionales Comerciales ha impulsado la Política Pública de contrataciones públicas a nivel estatal a través de los acuerdos y compromisos que ha adquirido con sus socios comerciales. Se precisa que se ocuparán los conceptos estatales/internacionalización, los cuales derivan y son relativos al concepto sociológico de Nación, debido a que es el alcance que se le quiere dotar a la situación que deviene a la celebración de Tratados Internacionales. Esto, se encuentra en contraposición a las relaciones internacionales, en las cuales interactúan dos conjuntos de naciones que tuvieron el aval de su población. Finalmente, se le proporcionará al lector evidencia del caso de la negociación del Tratado de Libre Comercio con la Unión Europea, capítulo 21. Se destacará la manera en la que participó el Gobierno Federal de México mediante la inclusión de las dependencias del Poder Ejecutivo (nivel Central) y las entidades federativas con la inclusión de entidades de sus respectivos gobiernos (nivel Subcentral) para los cierres de sus textos, mismos que están pendiente de firma, por lo que habrá un apartado de las implicaciones que derivarán de su formalización y ratificación por parte del Senado de la República.

The role of the federal states to negotiate and implement the public procurement chapters of free trade agreements in Mexico The research work establishes the connection between: (i) the signing of Mexico's International Trade Agreements that incorporate chapters on public procurement, and (ii) the creation, implementation and improvement of the Public Policy on state public procurement from 1994 to date. For this purpose, the main objective is to determine whether the commercial opening in International Trade Agreements has promoted the Public Policy of public procurement at the state level through the agreements and commitments it has acquired with its commercial partners. It is specified that the concepts of state/internationalization will be addressed, which derive from and are related to the sociological concept of Nation, since this is the scope that is intended to be given to the situation resulting from the celebration of International Agreements. This contrasts with international relations, in which there is interaction between two sets of nations that had the endorsement of their populations. Finally, the reader will be provided with case evidence of the negotiation of the Free Trade Agreement between Mexico the European Union, chapter 21. The way in which the Federal Government of Mexico participated will be highlighted by including the dependencies of the Executive Branch (level Central) and the federal entities with the inclusion of entities of their respective governments (Sub-central level) for the closing of their texts, which are pending signature, so there will be a section on the implications that will derive from their formalization and ratification by part of the Senate of the Republic.
